Terms & Conditions

These terms apply to all website design, development, and hosting services provided by WebDevise. Please read them before engaging our services.

Effective Date: 24 May 2025

The following terms and conditions govern the relationship between WebDevise (“we”, “us”) and the client (“you”). By making a payment or formally signing up to our services, you acknowledge that you have read and accept these terms in full.

1. What We Provide

Website Design & Build

When you sign up to a hosting plan, the design and build of your website is included — there is no separate upfront build fee. Depending on the plan you choose, your website includes:

Website Ownership

While your hosting plan is active, the website and its associated design, code, and assets remain the intellectual property of WebDevise. Should you cancel your plan, any discussion regarding the transfer of assets will be handled in writing at that time. Ownership is not transferred automatically upon cancellation.

2. Build and Delivery Timeframes

Once we have received your completed onboarding brief along with any brand materials or assets needed, we aim to deliver your first draft within 7 business days.

Revision turnaround follows the same timeframe — 7 business days from the point we receive your written feedback. If you are slow to provide materials, approvals, or feedback, timelines will adjust accordingly. Integrations requiring third-party systems may also affect delivery dates.

3. Plans & Monthly Pricing

We offer three hosting plans, billed monthly in advance. Pricing is in Australian dollars and excludes GST.

Changes to Plans or Pricing

Plan features and pricing may be updated from time to time. We will give you a minimum of 30 days notice before any material changes take effect. Continued use of the service following that notice period constitutes acceptance of the updated terms.

4. Billing and Payments

Your plan fee is charged monthly on the same date each billing cycle, or the closest available date. Payments are processed using the payment method nominated at sign-up.

Where a payment cannot be processed, we will make reasonable attempts to contact you. If the account is not brought up to date, we reserve the right to suspend your website until the outstanding amount is cleared. GST is applied where required under Australian law.

6. Support and Ongoing Maintenance

We are available during AEST business hours, Monday to Friday, and aim to respond to all support requests within one business day.

Where a technical fault is on our end, we will work to resolve it within 48 hours of being notified. Monthly maintenance — covering updates, plugin management, and performance checks — is included in Plus and Max plans.

Issues stemming from changes made by you or an external party may incur additional fees at our standard hourly rate. Any such fees will be communicated and agreed in writing before work is carried out.

7. Work Outside Your Plan

Any work that falls outside the scope of your chosen plan — including additional pages, design changes, new features, third-party integrations, or repairs resulting from client or third-party modifications — will be quoted and billed at a rate of $120 per hour (AUD, ex. GST).

We will always provide a written estimate and receive your approval before commencing any out-of-scope work. No additional charges will be applied without your prior agreement.

9. Asset Ownership & Transfer

When you sign up to a WebDevise hosting plan, your website is designed and built as part of that plan. Two formal transfer pathways exist for clients who wish to take ownership of their website assets upon cancellation:

Early Transfer — $499 (AUD, ex. GST)

Available to any client at the time of cancellation, regardless of how long they have been on a plan. Upon payment of the $499 transfer fee, WebDevise will provide all website files, code, design assets, and relevant documentation in an agreed format.

Loyalty Transfer — Free (after 6 consecutive months)

Clients who have maintained an active plan for 6 or more consecutive months are entitled to a full asset transfer at no additional cost upon cancellation. The 6-month period is calculated from the date of your first successful payment and must be uninterrupted — any lapse in payment or plan suspension resets the qualifying period.

Transfer Conditions (Both Pathways)

10. Intellectual Property

All content and materials you supply — including text, images, and branding — are assumed to be owned by you or used with appropriate permission. You are responsible for ensuring no third-party intellectual property is infringed. Any claims arising from content you provided are your responsibility.

All website assets created by WebDevise — including code, design files, graphics, and written content — remain the intellectual property of WebDevise until one of the two transfer pathways outlined in Section 9 has been formally completed. Ownership does not transfer automatically upon cancellation. A written transfer agreement signed by both parties is required in all cases before assets are released.

WebDevise reserves the right to display completed work in its portfolio and marketing materials. If you prefer we do not, please advise us in writing at the time of sign-up.

11. Liability

What We Are Not Liable For

Your Content

You are solely responsible for the content published on your website. WebDevise accepts no liability for legal issues arising from content you have submitted or approved for publication.

Indemnification

You agree to indemnify and hold WebDevise harmless from any claims, damages, or legal costs that arise out of your website content or how the site is used.

Force Majeure

WebDevise is not liable for delays or service interruptions caused by events beyond our reasonable control — including but not limited to natural disasters, infrastructure outages, government action, or platform-level failures.

12. Ending the Agreement

Either party may end this agreement with 30 days written notice. Your hosting and website will remain active through the end of your current paid period. WebDevise may terminate the agreement immediately — without notice — in cases of non-payment, a material breach of these terms, or abusive conduct.

13. Confidentiality

Both parties agree to keep any sensitive business information shared during the engagement confidential. This obligation survives the end of the agreement.

14. Governing Law

These terms are governed by the laws of Queensland, Australia. Both parties agree to attempt to resolve any dispute directly and in good faith before pursuing formal legal remedies.

15. Changes to These Terms

We may revise these terms periodically. Where changes are significant, at least 30 days notice will be provided. Amendments to individual client agreements require written agreement from both parties.
